There is no federal ban on synthetic Cannabinoids at present. Thus the present legal status of synthetic Cannabinoids is an evolving mess of local and state laws of United States. Products like K2 and spice that contains Cannabinoids are banned in some of the local jurisdictions. This has created a lot of confusion and many more prohibitions are making their way through the state legislature. Many drug testing procedures fail to detect the presence of synthetic Cannabinoids in the urine. Moreover there are various products available in the markets that help one passing a drug test in 2 days or very short span. Passing a drug test was never easier before!
At present there are no screening tests that are capable of detecting synthetic Cannabinoids in the urine specimens provided by the subjects. This is due to the fact that the pure synthetic Cannabinoids are difficult to obtain and the unwillingness of the laboratories to invest resources in the prospects of on site, rapid or lab based drug tests. There are still some reports of laboratories that are trying to develop GC/MS assays to detect the synthetic Cannabinoids. But there are still doubts on whether any of the synthetic Cannabinoids would be detected and what are the approximate cut offs to detect them.
Courts are now using the existing community supervision personnel so as to extend the surveillance reach in view of lack of methods to detect the use of synthetic Cannabinoids. Law enforcement and court marshals are considered to be effective in monitoring the behavior of the person where drug testing methods are insufficient. There are inspections of the client’s home, school, work, hangouts, etc to get a visible message. Courts have now established a sanction of greater severity if one is caught using synthetic Cannabinoids. It is better to refrain yourselves from such habits at the earliest as they can be the reason for many negative consequences. With a doubtful legal future and lack of methods for detection techniques, the use of synthetic urine will continue and will prove to be a challenging effort for the drug testing programs!
