Read about drug testing cases.
Drug testing is considered to be an effective deterrent to the use of illegal drugs. The fear of testing positive in a drug test or simply facing the dreadful consequences will deter an individual from using drugs. Although drug testing is direct invasion to the privacy rights of an individual, many employers and high school administrators have adopted drug testing policies in their establishment. Drug testing is important in case of child custody cases. The laws in United States dictate that the custody decisions are governed by the interests of the child. The physical and mental fitness of the parents is also to be taken into consideration when it comes to custody issue of the child. This is the reason why drug testing comes into picture in child custody cases.
Drug testing serves a number of reasons in a child custody case. The test helps to determine whether or not a parent is using illegal drugs when seeking custody. Drug testing cases also determines whether the custody should be changed because the parent has started abusing drugs after being granted the custody of the child. If one of the parent tests positive for substance abuse during the court proceedings, the court orders random drug testing. If the non custodial parent tests positive then it further triggers custody and the parenting time hearings. The court restricts the non custodial parent’s visitation time. The court will either ask for supervision during parenting time or terminate the visits all together.
The use of illegal drugs impacts the rights to custody and the parenting time of the non custodial parent. Thus it is necessary to consider retaining the legal representation in case of child custody. One should avoid the use of drugs and remember that the use can ruin their lives, reputation in the society and their career. There are several home remedies for drug test that have helped the abusers to come clear in a test. However they might not work in all the cases. The only best way to pass a drug test is to stop the use of drugs completely!
