Drug Testing School Employees
Drug Testing is a debatable issue and runs a fine line between the right of privacy of individuals and the right of the authorities to maintain a drug free environ in their establishment. Particularly contentious is making school students undergo a drug test and having them do many things if they do not pass drug test. Another related issue is drug testing school employees. The decision of the Sixth Circuit Court of Appeal in the Knox Vs Knox2 case is a pointer in this direction. The court did not extend the benefit of right to privacy, as idealized in the fourth amendment, to the educators in safety sensitive operations. This was a culmination of a long-standing demand – surely if young students are being tested for drugs, why should school employees not be.
Drug tests are meant to discourage drug use. The fear of testing positive and facing the consequences is enough to deter many drug users away from this self-destructive habit. In this context not being able to pass drug test can mean, after many such failures that is, a suspension from school and unwanted interruption in the academic career. It is better to start with young kids to nip this bad habit in the bud. School drug tests are usually urine tests. The hair follicle drug test sensitivity is higher, but the test is expensive and not really required at this level.
School employees, especially those in safety sensitive operations and those in positions to influence the behavior of students, should also be free from drug use. They too should be tested. Drug use leads to accident-prone behavior. In this case such behavior can endanger students. Drug use by such employees can also set a bad example before such students. Some crooked ones may even introduce students to such dirty habits and later supply them with drugs. If students are to be kept free of this vice then good examples need to be set before them. This is in addition to having a safe environment in the school. Therefore the decision will come as a huge relief and encouragement for all those who hate this menace of drug use.
