Drug testing has always been a controversial issue ever since it’s introduction in the society and is often debated. Employment drug test is a new and evolving issue in United States. The drug testing policies came into picture in 1988 when the US central legislature passed a Drug free Workplace Act. Although the act was mandated for the federal employees, many private employers also decided to adopt the testing policies. The adaptation of drug testing policies by the private employers is in sync with the right of employers and most importantly with their eagerness to maintain a drug free workplace. The drug testing programs prevents accidents and conflicts at the workplace, help maintain order and prevent absenteeism and promoting the productivity of the employees.
On the other side the random drug testing is the direct invasion to the privacy right of the employees. A recent study indicated that there is only a marginal difference between the productivity of the abusers and the non abusers when compared on grounds of job retention and attendance. Therefore an important question arises: is drug testing for the employees justified? There is no clear answer to the question. There are several cases wherein an employee might be asked to undergo a drug test. There is applicant drug testing which is now a part of employment hiring process. The employees are also subjected to random drug tests or a drug test might be called in case of suspicion or post accident.
Employers are required to take certain precautions before conducting the drug testing programs in their establishment. The drug test can only be performed after a written consent that is obtained from the subject employee. The employees should be informed in advance that the drug tests are a part of the recruitment as well as the job continuation process. The employer needs to ensure that the drug test is performed on all the employees. The program should comply with all the legal requirements. The drug test should be performed by a certified drug testing lab. The labs should ensure that the subjects have not attempted to cheat the labs and used tactics like drink water marijuana out of system or substitution methods.
